Conditions of Sale

1. General

1.1. You may have other rights granted by law including your statutory rights as a consumer, and these terms do not affect those rights.

1.2. No binding contract will exist between us until we have accepted your order. Except as described in paragraph seven (7) below, you may not cancel any order which has been accepted by us.

1.3. All goods are sold subject to availability.

1.4. These terms supersede all previous verbal or written statements and agreements relating to the goods and/or services. All information contained in our sales literature or correspondence is provided for guidance only and does not form part of this contract, unless we agree otherwise with you in writing.

1.5. None of our representatives, agents or sales persons have authority to vary, amend or waive any of these Terms on our behalf and no amendment or addition to any of these Terms shall be deemed to have been accepted unless we agree otherwise with you in writing.

2. Description of Goods & Services

2.1. Descriptions of the goods are set out on our website. Whilst we will attempt to ensure that there are no changes to the goods to be supplied, it is possible that there might be some minor variations to the description and/or specification of the goods which arise by virtue of changes made by the manufacturers of the parts supplied which form part of the goods.

2.2. We have made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the actual goods.

2.3. We reserve the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice.

2.4. In the unlikely event that the goods are no longer available, we reserve the right to cancel the contract and refund any amount paid.

2.5. When ordering, you must provide us with details of the relevant prescription that is to be applied to the goods. All prescriptions provided to us must have been obtained from a registered medical practitioner or registered ophthalmic optician following a sight test by him or her within the last 2 years.

2.6. We will rely upon the prescription provided by you and the goods provided will contain lenses matching the prescription that you provide us with.

2.7. If you are unsure of the relevant prescription to be applied to the goods, please consult a registered medical practitioner or registered ophthalmic optician before placing an order.

3. Delivery & Carriage Charges

3.1. Goods will normally be dispatched within 11-14 working days and any estimated dispatch date is a an estimate, which can change without notice.

3.2. We will normally deliver goods within 1-2 working days of dispatch.

3.3. Your order may arrive in more than one delivery

3.4. If for any reason (not due to our fault) you do not accept delivery of any of the goods in accordance with this paragraph then we may charge you an additional fee to cover any reasonable additional direct costs incurred by us as a result (including additional insurance, delivery, storage or similar charges).

3.5. If the goods are lost or damaged in transit, please let us know promptly.

3.6. We will endeavour to honour our responsibilities under this contract within a reasonable timeframe unless it is impossible because of circumstances outside of our control. In particular we will not be responsible for delays caused by our suppliers.

3.7. Events outside our control, which are not reasonably foreseeable, shall be considered force majeure, meaning that we are released from our obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

3.8. Unless stipulated otherwise, prices exclude delivery.

3.9. Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.

4. Price of Goods & Payment

4.1. The price for the goods will be the price stated on our website, set at the date on which you purchase your order.

4.2. The price for the goods includes any VAT payable.

4.3. Shipping costs and payment fees are recognised before confirming the purchase.

4.4. Unless we agree otherwise in writing, you must pay to us the price for the goods when placing your order.

4.5. All products remain property of T&T Vision until full payment is made.

4.6. If you are under 18 years old you must have parents' permission to buy from T&T Vision.

5. Identity Protection

5.1. All transfers conducted through our website are handled and transacted through third party dedicated gateways to guarantee your protection.

5.2. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction (for example: Paypal) as they are responsible for the transactions made.

6. Inspection of Goods

6.1. Upon receipt of the goods you should carefully inspect them. If any of the goods are damaged or lost, please contact us to inform us of the problem and do not use the goods.

6.2. If the prescription stated does not match the prescription ordered, please contact us to inform us of the problem and do not use the goods.

7. Returns Policy

7.1. We will refund or exchange a purchase for any reason within 30 (thirty) days, beginning with the day after the date of receipt of the goods.

7.2. To obtain a refund or exchange, you MUST first contact T&T Vision Customer Services within the aforementioned timescale who will authorise the refund and send you a returns form to complete and send back with your goods. You can do this via email or post.

7.3. Products must reach us in "AS NEW" condition with all packaging, labelling and stickers intact.

7.4. When returning goods, please be sure to wrap the package carefully as damages/losses to the goods during transit back to T&T Vision are at the customer's risk.

7.5. Make sure you have included your returns form.

7.6.1. If you wish to return the item for a refund we reserve the right to deduct the p&p charge from the refunded amount in respect of our postage costs.

7.6.2. If you wish to return the item for an exchange we reserve the right to charge for any additional p&p costs for sending out the exchange.

7.7.1. Refunds will be issued within 7 (seven) days of receipt of goods. You will be contacted and updated via email once your refund has been processed. Please note that we can only credit the same account of the original purchaser of the product.

7.7.2. Exchanges will be dispatched within 7 days (seven) of our receipt of the goods to be exchanged. You will be contacted and updated via email once your exchange has been processed.

7.8. Please note that items bought as presents can only be refunded or exchanged with the permission of the original purchaser.

7.9. We recommend that you get a certificate of postage (free from any Post Office) for any returns you make. Always retain proof of postage.

7.10. Please return all exchanges/refund requests to: T&T Vision Returns Department, 8 South Road, Herne Bay, Kent, CT6 5AR.

8. Faulty Goods

8.1. If there is a problem with the goods, please notify us by email or in writing providing details of the problem. We will contact you with instructions for returning the faulty goods.

8.2. If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been returned and checked by us. The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

9. Ownership & Responsibility of Goods

9.1. You will be liable for any loss or damage to the goods from the time of delivery unless such loss or damage is demonstrably caused by our negligence.

10. Liability

10.1. Nothing in these Terms excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which by law we are not permitted to limit or exclude.

10.2. Our maximum liability (and that of our employees, agents and subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed £10,000.

10.3. In all other cases, our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates.

10.4. In no circumstances will we (or our employees, agents or subcontractors) be liable to you for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings.

10.5. You will be liable for any loss or damage to the goods from the time of delivery unless such loss or damage is demonstrably caused by our negligence.

10.6. The products sold on this website have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the UK.

11. Your Right to Transfer the Contract

11.1. This contract is personal to you. Nobody other than you will be able to benefit from this contract. You may not transfer your rights or the benefit of any of the provisions of this contract to any other person without our prior written permission.

12. Our Right to Transfer the Contract

12.1. We may assign or subcontract the contract or any part of the contract to any person, firm or company.

13. Communications

13.1. Any communications between us regarding this contract that are required to be in writing must be sent by first class post or delivered by hand. Any written communication will be treated as having been served on the person receiving it 3 working days after posting (if sent by first class post) or at the time of delivery (if delivered by hand).

14. Trade or Business Customers

The following conditions apply to orders placed by Trade or Business Customers.

14.1. Orders may not be cancelled except with our mutual agreement and having been confirmed in writing by a Partner from T&T Vision. We reserve the right to make cancellation and/or re-stocking charges.

14.2. Claims for missing or damaged items must be made within 2 days of delivery.

You always have the right to request T&T Vision to delete or correct the information held about you. By accepting the T&T Vision Conditions, you agree to the above.
